Driver Busted For DWI With BAC Double Legal Limit In Scarsdale, Police Say

A Westchester man was busted driving with a blood alcohol content double the legal limit during an early morning traffic stop in Scarsdale, police said.

An officer from the Scarsdale Police Department on patrol at approximately 7 a.m. on Saturday, Dec. 1 spotted a Nissan Sentra swerving on Post Road, repeatedly hitting the curb, prompting a traffic stop.

During the traffic stop near the intersection of Post Road and Ferncliff Road, police said that the driver, Mount Vernon resident Fernando Pinto, stated that he had one Corona beer at a White Plains bar earlier. The officer noted that Pinto “had a strong odor of an alcoholic beverage emanating from (his) breath and (his) eyes were glassy and bloodshot.”

Pinto, 46, proceeded to fail multiple Standardized Field Sobriety Tests, and he was taken into custody for the alleged DWI. At Scarsdale Police Headquarters, Pinto failed a breathalyzer with a blood alcohol content of .16 percent, double the legal limit. 

He was arrested and charged with driving while intoxicated and operating a motor vehicle with a blood alcohol content greater than .08 percent. He was also cited for driving without a license, moving from a lane unsafely and failure to use a designated lane.

Following his arraignment, Pinto was released and is scheduled to appear in Scarsdale Village Court on Wednesday, Dec. 5 to respond to the charges.
