Police: Tuckahoe Man Drunk with Three Teens in Car

TUCKAHOE, N.Y.  — A Tuckahoe man is due back in court next week to face a felony driving while Intoxicated charge.

Matthew McDevitt, of Highview Avenue was arrested last Saturday at 11 p.m. after he struck a construction barricade at the intersection of Lake and Main streets. When police arrived at the scene, they found McDevitt pulled over with damage to the right side of his vehicle. In the car with McDevitt were his 16-year-old daughter, a 16-year-old Eastchester girl and a 15-year-old Tuckahoe girl. No one was injured, however  the 16 year old from Eastchester was taken to Lawrence Hospital later that night, where she was treated and released for rib pain.

McDevitt was taken to police headquarters where it was determined he had a blood alcohol content of 0.20, more than twice the legal limit. He was charged with misdemeanor DWI and felony DWI under Leandra's law.

Leandra's Law, or the Child Passenger Protection Act, was signed into law in New York State in 2009. The law makes it an automatic felony to drive drunk with a person age 15 or younger inside the vehicle.

McDevitt was released without bail at his arraignment on Tuesday. He is scheduled to be back in court Tuesday.
